WorldStage– The legal team for former Attorney General of the Federation, Abubakar Malami, is seeking court intervention over his continued detention by the Economic and Financial Crimes Commission (EFCC).
His lawyers argue that the detention is unlawful and a violation of his constitutional rights.
The EFCC is reportedly holding Malami over allegations of financial malfeasance, including the mismanagement of recovered Abacha loots, terrorism financing, money laundering, and the operation of suspicious bank accounts.
The commission stated that a lawful remand order was obtained and that Malami had initially refused to honor several invitations.
Malami’s lead counsel, Barrister Mohammed Sheriff Elhassan, however insists his client has fully cooperated, voluntarily submitting for interrogation multiple times in late November and December 2025.
Elhassan claims the current bail conditions are “oppressive and unattainable” and that the EFCC unlawfully revoked an initial administrative bail after Malami’s return on December 2, 2025.
Malami’s team is filing for court intervention to secure his release, emphasizing that detaining an individual for more than 24 hours without court approval is unconstitutional in Nigeria.
The EFCC is reportedly compiling charges against Malami, who remains in custody as of December 11, 2025.
The investigation involves scrutinizing 46 bank accounts and significant investments in Kebbi State.
