WorldStage– The Federal High Court sitting in Dutse, Jigawa State, has dismissed a suit challenging the All Progressives Congress (APC) primary election for the Hadejia/Auyo/Kafin Hausa Federal Constituency.
The case was dismissed because it was filed after the 14-day statutory deadline for pre-election disputes and lacked a necessary affidavit regarding related legal actions.
In addition to dismissing the suit, the court ordered the payment of ₦5 million in costs to the defendants, which included the APC, Jabo, and INEC.
The court affirmed Aliyu Hussaini Usaini Jabo as the APC candidate for the constituency, with Justice Muhammad Ibrahim dismissing the suit due to lack of jurisdiction, citing that it was filed beyond the 14-day statutory limit for pre-election cases.
The plaintiff, Ishaq El-Yakubu Nabayi, also failed to file a required affidavit regarding the multiplicity of actions.
A cost of ₦5 million was awarded against the plaintiff to be paid to the defendants, which include the APC, the winning candidate, and INEC.
The legal challenge focused on alleged irregularities in the June 2026 contest.
